Why a commissary

In Utah, it’s state law — not a local rule.

Under Utah’s Mobile Food Business Sanitation rule (Utah Admin. Code R392-102), a mobile food business must use a commissary, and you have to hand your local health department a written, signed commissary agreement — renewed every year — to get or keep your permit. The rule is blunt about the alternative:

“No food or equipment may be stored at a home residence, storage unit, garage, or other unapproved structure.”

Operating without one — or out of a home kitchen — puts your permit at risk. PCS is your permitted base, and we handle the paperwork with the Utah County Health Department.

One exception, so you hear it from us: if you’re a tier one operator — no temperature-controlled food, nothing prepped or held overnight, everything done on the cart including cleaning — your health officer can waive the commissary requirement. If you cook, hold food hot or cold, or prep ahead, that isn’t you, and the rule applies.
